These Terms of Service ("Terms") govern your access to and use of the websites, mobile applications, and related services (collectively, the "Service") offered by BLP Transportation, LLC ("BLP," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 18 years old and authorized to enter into a binding contract on behalf of yourself or the business you represent. Carriers must hold a valid US DOT or MC authority, and brokers must hold a current FMCSA property broker license (MC-B).
2. Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at security@blptransportation.com if you suspect unauthorized use.
3. Subscription & Billing
BLP offers paid subscription plans billed monthly or annually. Your subscription renews automatically at the end of each billing period until canceled. You can cancel from your dashboard at any time. Fees already paid are non-refundable except as required by law.
4. Free Trial
New users are entitled to a 10-day free trial. We will not charge your payment method during the trial. You may cancel any time before the trial ends without being billed.
5. Your Content
You retain ownership of the data and content you submit to the Service (loads, invoices, documents). By submitting content, you grant BLP a non-exclusive license to use, display, and distribute such content as necessary to provide the Service.
6. Prohibited Conduct
You agree not to: (a) post fraudulent, duplicate, or misleading loads; (b) misrepresent your carrier or broker authority; (c) scrape or reverse-engineer the Service; (d) use the Service to transmit unsolicited communications; (e) violate any applicable federal or state transportation regulation, including FMCSA rules on hours of service.
7. Third-Party Services
The Service includes integrations with third-party tools (e.g., Stripe, QuickBooks, Samsara). Your use of those tools is subject to their respective terms. BLP is not responsible for the availability or performance of third-party services.
8. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE." To the fullest extent permitted by law, BLP disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Rate data, credit scores, and market averages are provided for informational purposes only.
9. Limitation of Liability
To the maximum extent allowed by law, BLP's aggregate liability for any claim arising from the Service will not exceed the fees you paid us in the 12 months preceding the claim. BLP will not be liable for indirect, incidental, or consequential damages including lost profits or lost data.
10. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Disputes will be resolved exclusively by binding arbitration in Dallas, Texas under the rules of the American Arbitration Association, except that either party may seek equitable relief in court.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced via email and in-app notice at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.
